Terms and Conditions

A. These terms of service (“Terms”) govern your use of the services provided through https://www.litex.in and/or the Litex.in mobile app (collectively referred to as the “Platform,” together with the services offered via the Platform, the “Services”). These Terms also incorporate our privacy policy, available at https://www.litex.in/privacy-policy (“Privacy Policy”), along with any additional or supplemental terms, policies, and notices issued by us from time to time (“Supplemental Terms”). The Privacy Policy and Supplemental Terms are integral parts of these Terms. In the event of any conflict between these Terms and the Supplemental Terms related to specific Services, the Supplemental Terms will take precedence.

B. These Terms form a legally binding contract between Litex.in (UrbanClap Technologies Private Limited, incorporated under the Companies Act, 2013, with its registered office at [address], and referred to here as “Litex.in,” “we,” “our,” or “us”) and you, a user of the Services, or any entity booking Professional Services (as defined below) on behalf of users (“you” or “Customer”). By accessing or using the Services, you represent and warrant that you have the legal authority and capacity to agree to these Terms and bind yourself accordingly. If you represent another individual or entity, you also confirm that you have the required authority to bind them to these Terms.

C. By utilizing the Services, you agree that you have reviewed, understood, and are bound by these Terms, as they may be updated from time to time. These Terms override any prior written agreements with you. Should you disagree with any part of these Terms or fail to meet the outlined requirements, please discontinue use of the Services immediately.

1. Services

(a) The Services involve providing the Platform, which enables users to schedule and book various home-based services through independent third-party service providers (“Service Professionals”). Litex.in facilitates the transfer of payments to Service Professionals for their work and collects payments on their behalf.

(b) The services delivered by Service Professionals are referred to as “Pro Services.” Litex.in’s role is limited to facilitating your booking; we do not provide the Pro Services directly and are not responsible for their delivery. Service Professionals are solely responsible for the Pro Services they offer, and they are not employees, agents, or partners of Litex.in.

(c) The Platform is for personal, non-commercial use unless otherwise specified in a separate agreement. It is intended for users in India, and any use of the Services outside this region is deemed to be governed by the local terms applicable to that jurisdiction.

(d) The Services may be offered under various brands owned by or licensed to Litex.in and its affiliates.

(e) A crucial aspect of the Services includes sending you messages (via text, email, or WhatsApp) regarding your bookings, service updates, or marketing initiatives. You may opt out of promotional communications, though doing so may affect the delivery of certain Services.

(f) You may be required to provide identification documents to avail of certain Services, and failure to do so may result in denial of access to those Services.

(g) Litex.in Credits:
(i) Litex.in may, at its sole discretion, offer promotional codes redeemable for credits or other benefits related to the Services, subject to specific terms ("Litex.in Credits").
(ii) These Credits must be used legally and for their intended purpose, and they cannot be sold, duplicated, or transferred without express permission.
(iii) Litex.in Credits are non-cash, non-transferable, and may be revoked or disabled at any time for any reason.
(iv) Litex.in reserves the right to withhold or deduct credits if there is suspicion of fraud or misuse.

2. Account Creation

(a) To use the Services, you must create an account on the Platform ("Account"). You must be at least 18 years old to do so.

(b) You warrant that the information provided for account creation is accurate and will promptly update any changes.

(c) You are responsible for maintaining the confidentiality of your account credentials and must notify us immediately if there is any unauthorized use.

(d) You are accountable for all activities under your account, even if performed by others, and we bear no liability for unauthorized access.

(e) You agree to receive communications regarding payment requests, Service updates, and promotional offers.

3. User Content

(a) Our Platform may allow you to post reviews, feedback, or other content (“User Content”).

(b) You must not post false, misleading, or defamatory information. We may use reviews for quality control purposes and reserve the right to remove users based on inappropriate behavior.

(c) By posting User Content, you grant us a worldwide, perpetual, royalty-free license to use, display, or modify the content as needed.

(d) Litex.in reserves the right to remove User Content that violates these Terms.

4. Data Use

(a) We may collect and use your personal data in accordance with our Privacy Policy.

(b) You agree to us sharing data with third-party service providers where necessary to deliver the Services.

5. Bookings

(a) The Platform allows you to schedule Pro Services. While we try to accommodate your requested times, there may be instances where rescheduling is necessary.

(b) Once confirmed, you will receive a booking confirmation via SMS, email, or notification.

(c) Cancellations prior to confirmation are free of charge. Cancellation fees may apply after confirmation, per our policy.

(d) If a Service Professional is unavailable, we may substitute them with another qualified professional.

6. Pricing, Fees, and Payment

(a) Litex.in reserves the right to charge for Services and related fees.

(b) You agree to pay all fees and charges for Pro Services as indicated at the time of booking.

(d) All charges are non-refundable unless otherwise specified by law or Litex.in.

7. Customer Conduct

(a) Litex.in prohibits any form of discrimination against Service Professionals.

(b) You must treat Service Professionals with respect and provide a safe environment for them to perform their services.

(c) Service Professionals reserve the right to refuse services if the conditions are inappropriate or if you behave in a discourteous or abusive manner.

(d) You must report any inappropriate behavior by Service Professionals within 48 hours.

8. Third-Party Services

The Platform may include links to third-party services. We are not responsible for the content or accuracy of these third-party services.

9. Responsibilities

You warrant that all information provided is accurate, and you agree not to use the Services for any unlawful or inappropriate activities.

10. Intellectual Property

Litex.in owns all intellectual property related to the Services, and you are granted a limited, non-transferable license to use the Platform.

11. Termination

Litex.in may suspend or terminate your account if you breach these Terms, engage in inappropriate conduct, or for other legitimate business reasons.

12. Disclaimer

The Services are provided "as is" without any warranties, and Litex.in will not be held liable for any damages arising from their use.

13. Indemnity

You agree to indemnify and hold Litex.in harmless from any claims arising from your use of the Services.

14. Governing Law

These Terms are governed by the laws of India, and disputes will be resolved through arbitration in New Delhi.

15. Grievance Redressal

16. Miscellaneous

Litex.in reserves the right to modify these Terms at any time. You will be deemed to accept any changes by continuing to use the Services.
